LA FREEDOM CAUCUS APPLAUDS PASSAGE OF BILL REIGNING IN UNFAIR LAWSUITS
BATON ROUGE, LA — Today marks a significant victory for fairness and personal responsibility in Louisiana as House Bill 431, authored by LA Freedom Caucus member Rep. Emily Chenevert, successfully passed the legislature today and is headed for the governor's desk. HB431 transitions Louisiana from a pure comparative fault system to a modified comparative fault system, ensuring that plaintiffs who bear the primary responsibility for their injuries (51% or greater fault) can no longer recover damages from other parties. This brings Louisiana in line with the 34 states who have a 50% to 51% threshold.
"By establishing a clear threshold for personal accountability, we are reinforcing the idea that individuals should not benefit from situations primarily caused by their own negligence," said Rep. Chenevert. "This reform is intended to lower insurance costs. It will help reduce unnecessary lawsuits and promote economic growth across our state."
The LA Freedom Caucus strongly supports HB431, emphasizing its critical role in enhancing Louisiana's legal climate and fostering a fair and predictable justice system. This bill will not only encourage personal responsibility but also protect hardworking Louisianans from unwarranted financial strain resulting from excessive litigation.
The bill is set to take effect on January 1, 2026, if signed by the governor, marking a new era of fairness and accountability in Louisiana’s legal landscape.
